The terms that govern your use of our website and the renovation services we provide across the USA.

1. Acceptance of Terms

By accessing or using the Home Restore Nest website (homerestorenest.com) and any of our renovation services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our website or engage our services. These Terms constitute a legally binding agreement between you ("Client", "you") and Home Restore Nest ("Company", "we", "us").

These Terms apply to all visitors, users, and others who access or use our services. Specific services may have additional terms that will be presented at the time of engagement and incorporated by reference into these Terms.

2. Company Information

Home Restore Nest is a home renovation and remodeling company incorporated under the laws of the Commonwealth of Massachusetts, USA. Our principal place of business is 235 Ashley Blvd, New Bedford, Massachusetts 02746. We hold active general contractor licenses in every state in which we operate, and our license numbers are available upon request.

The specific scope, pricing, timeline, and deliverables for each project are defined in a separate written contract ("Project Agreement") executed before work commences. In the event of any conflict between these Terms and a Project Agreement, the Project Agreement governs.

4.1 Permitted Use

You may use our website for legitimate purposes including: reviewing our services, submitting inquiries, booking consultations, and accessing project resources. You agree to provide accurate, current, and complete information when using forms or submitting inquiries.

5. Quotes, Pricing & Contracts

5.1 Estimates & Proposals

All preliminary estimates provided before a formal site visit are non-binding and based on information you provide. A binding fixed-price proposal requires an on-site or virtual consultation and is valid for 30 days from the date of issuance, unless otherwise stated.

5.2 Fixed-Price Contracts

Once a Project Agreement is signed, the price is fixed for the agreed scope of work. Any changes to scope requested by the Client will be documented in a written Change Order with adjusted pricing and timeline. No Change Order is binding until signed by both parties.

5.3 Deposit & Payment Schedule

A deposit of 25% of the total contract value is due upon signing to secure scheduling and order materials. Subsequent payments follow milestone schedules defined in the Project Agreement. Final payment is due upon completion of the punch-list walkthrough.

7.1 Craftsmanship Warranty

We provide a 5-year warranty on all craftsmanship (labor) performed by our team, effective from the project completion date. Full-home flagship projects include a 10-year warranty. This warranty covers defects in installation but does not cover:

Materials used in projects are covered by their respective manufacturer warranties. We pass through all manufacturer warranties to the Client and assist with claim paperwork, but are not responsible for manufacturer decisions or warranty coverage.

8. Limitation of Liability

To the maximum extent permitted by law, Home Restore Nest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to loss of profits, loss of use, loss of data, business interruption, or cost of substitute services.

Our total aggregate liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim. This limitation applies regardless of the legal theory of recovery.

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to: weather events, supply chain disruptions, labor disputes, government actions, material shortages, or discoveries of concealed conditions (asbestos, lead, structural defects) that require remediation.

9. Indemnification

The Client agrees to indemnify, defend, and hold harmless Home Restore Nest, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) the Client's breach of these Terms or any Project Agreement; (b) the Client's misrepresentation or failure to disclose material information about the property; (c) the Client's violation of any law or third-party rights; or (d) any work performed on the property by the Client or third parties not authorized by us.

10. Cancellation & Refunds

10.1 Cancellation by Client

The Client may cancel a project by written notice at any time. If cancellation occurs:

We reserve the right to cancel a project if: (a) the Client fails to make timely payments; (b) the Client breaches the Project Agreement; (c) site conditions are discovered that make the project unsafe or infeasible; or (d) Client requests scope changes that we cannot accommodate. In such cases, the Client pays only for work completed up to the cancellation date.

11. Intellectual Property

All content on our website including text, graphics, logos, images, and software is the property of Home Restore Nest or its licensors and is protected by US and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

Design plans, drawings, and specifications created for your project remain our intellectual property until final payment is received, at which point they are transferred to the Client for use on the specific project property only. Redistribution or reuse on other properties is prohibited without our consent.

12. Privacy

Our collection and handling of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms. By using our services, you consent to the data practices described in the Privacy Policy.

13. Newsletter Subscription

If you subscribe to our newsletter, you consent to receive periodic marketing emails. You may unsubscribe at any time by clicking the unsubscribe link in any email or visiting our unsubscribe page. We honor all unsubscribe requests within 10 business days.

14. Disclaimer

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components.

15. Governing Law & Dispute Resolution

These Terms and any dispute arising from them shall be governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles. Any legal action must be brought in the state or federal courts located in Bristol County, Massachusetts.

Before initiating litigation, both parties agree to attempt good-faith resolution through mediation by a mutually agreed mediator. If mediation fails within 60 days, either party may initiate binding arbitration through the American Arbitration Association under its Construction Industry Arbitration Rules.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to our website. For existing Project Agreements, the Terms in effect at the time of contract signing govern that project. Continued use of our website after changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with any Project Agreements and our Privacy Policy, constitute the entire agreement between you and Home Restore Nest and supersede all prior or contemporaneous communications, proposals, and understandings, whether oral or written.
